TAP THE TRADESTerms of Service
Effective date: October 1, 2026
These Terms of Service are an agreement between you and TAPMYTRADES.COM LLC, doing business as Tap The Trades. They apply to the Tap The Trades website, mobile applications, and related services. By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 18 years old and able to enter a binding agreement to use the Service. If you use the Service for a company or another organization, you represent that you have authority to accept these Terms for it.
You must provide accurate account information, keep it current, protect your credentials, and notify us promptly about unauthorized use. One person may not impersonate another person or company. Candidate and employer accounts have different permissions. Company owners are responsible for team members they invite and for removing access when it is no longer needed.
2. What Tap The Trades provides
Tap The Trades helps candidates create profiles, find and apply for work, and communicate with employers. It helps employers create company profiles, publish job posts, search authorized candidate profiles, review applicants, and communicate with candidates.
Tap The Trades is a software platform. We are not the employer, candidate, staffing agency, background screening company, union, or party to an employment agreement between users. We do not make hiring decisions and do not guarantee a job, candidate, response, interview, hire, credential, screening result, or employment outcome.
3. Candidate and employer responsibilities
Candidates
Candidates must keep their identity, work history, skills, certifications, pay information, screening answers, union status, work-limits text, availability, photos, intro videos, and other profile content accurate. Tap The Trades does not independently verify every statement. Candidates control whether their profile is visible and should not post confidential information they do not want authorized employers to review.
Employers
Employers are solely responsible for lawful job posts and hiring practices. They must follow applicable non-discrimination, equal-employment, wage, pay transparency, labor, union, accessibility, privacy, background-check, drug-screening, recordkeeping, and employment laws. Employers must obtain any notices, authorizations, or consents required before screening a candidate or using candidate information for a hiring decision.
Employers may use candidate information only for legitimate recruiting, hiring, workforce, and related business purposes. They may not scrape the candidate database, build an unrelated contact list, resell profiles, or use information to discriminate, harass, or make an unlawful decision.
4. User content and license
You keep ownership of content you submit, including profile text, photos, intro videos, company logos, job posts, messages, and support or report details. You represent that you have the rights and permissions needed to submit it and that our permitted use will not violate another person's rights.
You grant Tap The Trades a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, display, and moderate your user content only as needed to operate, secure, support, and improve the Service and to meet legal obligations. This license ends when the content is deleted, except for anonymized records and copies that must remain for security, accounting, dispute, or legal reasons. This license does not give us permission to use a candidate's photo or video in advertising without separate permission.
5. Acceptable use, moderation, reporting, and blocking
You may not use the Service to:
- Break a law, regulation, court order, contract, or another person's rights.
- Post false, deceptive, fraudulent, discriminatory, threatening, harassing, hateful, sexually exploitative, or obscene content.
- Spam users, harvest contact information, run a scam, or send malware or harmful code.
- Access another account, bypass access controls or rate limits, probe security, or disrupt the Service.
- Copy, scrape, reverse engineer, resell, or commercially exploit the Service except as law expressly permits.
There is no tolerance for objectionable content or abusive users. We use rule-based and automated moderation on user-authored profiles, company descriptions, job posts, and messages. Automated tools can make mistakes and do not detect every violation. Users can report an account or content and block another account. Blocking stops messages between the two accounts and hides each one's profile and job posts from the other.
We act on reports within 24 hours. When content breaks these Terms, we remove it and suspend or terminate the account that posted it. We may also limit features or terminate access when we reasonably believe these Terms, user safety, or law require action, and we may preserve relevant records while reviewing a report.
6. Hiring, communications, and third parties
Users decide whether to contact, interview, hire, employ, or work with each other. Verify identities, licenses, certifications, references, screening results, insurance, pay, work conditions, and legal requirements independently. Use care before sharing sensitive information or meeting in person.
The Service uses third-party providers for authentication, hosting, storage, voice transcription and drafting, content moderation, billing, email, and mobile delivery. Their separate terms may apply when you use their service, such as Google Sign-In or Stripe checkout. We are not responsible for a third-party site or service that we do not control.
7. Employer plans and Stripe billing
Candidate accounts are free. Employer plan prices, features, usage limits, and commitment terms appear before checkout. Current subscription plans are charged at checkout and billed monthly, with a 3-month minimum commitment. Stripe processes payment details on its checkout or billing portal. Tap The Trades stores billing status and Stripe identifiers, not full card details.
A company owner manages billing. Team members cannot purchase, change, or cancel a company plan. During an active minimum commitment, cancellation is scheduled for the commitment end and monthly billing continues through that date. Otherwise, cancellation is scheduled for the current billing period end. The billing screen shows the applicable cancellation date and lets the owner resume before it takes effect.
Taxes, refunds, credits, and any different offer terms are governed by the terms shown at checkout and applicable law. These Terms do not create a separate refund promise. We may change future prices or plan features after giving any notice required by law, but a change does not rewrite a completed checkout.
8. Software and app marketplace license
Subject to these Terms, Tap The Trades grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the website and mobile application for their intended purpose. We and our licensors keep all rights in the Service, software, design, branding, and content that users did not submit.
If you obtained the mobile app through an app marketplace, its usage rules also apply. The marketplace operator is not responsible for Tap The Trades support, maintenance, warranties, user content, or claims about the app, except where its own terms or applicable law say otherwise. The operator may enforce this license as a third-party beneficiary when its terms require that right.
9. Suspension, termination, and account deletion
You may stop using the Service at any time. Signed-in users can request account deletion through Settings or More. The public account deletion page explains the process. Deletion does not erase anonymized moderation, security, or accounting events described in the Privacy Policy.
We may suspend, restrict, or terminate access when reasonably needed to enforce these Terms, protect users or the Service, respond to fraud or security risk, comply with law, or address nonpayment. Where practical and lawful, we will give notice or a chance to correct the issue. Terms that by their nature should survive termination remain in effect, including ownership, payment obligations already incurred, disclaimers, and liability limits.
10. Disclaimers and limits of liability
To the fullest extent allowed by law, the Service is provided "as is" and "as available." We do not promise uninterrupted or error-free operation, complete moderation, accurate user content, or a particular hiring result. Rights that cannot lawfully be waived remain in force.
To the fullest extent allowed by law, Tap The Trades and its officers, employees, and contractors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, hiring decisions, employment disputes, or conduct between users arising from the Service. Any limitation or exclusion applies only where applicable law permits it.
11. Changes, disputes, and applicable law
We may update the Service or these Terms. We will post revised Terms, update the effective date, and give any additional notice required by law. Continued use after revised Terms take effect means you accept them, where that form of acceptance is permitted.
Applicable law governs these Terms and any dispute. A court with lawful jurisdiction may hear a dispute. Before filing a claim, contact us so both sides can try to resolve it informally. Nothing here limits a right or remedy that law does not allow us to limit.
If a court finds part of these Terms unenforceable, the remaining terms stay in effect. A delay in enforcing a term is not a waiver. These Terms and the Privacy Policy are the agreement between you and Tap The Trades about the Service, except for terms presented and accepted at Stripe checkout or by an app marketplace.
